People in India usually say that Indian judiciary is lacking in execution and cases are still pending. However, this time in the span of week things have changed drastically and important decisions have been made by the Indian Judiciary are being hailed by the people of India. The major reason behind this huge applause to judiciary is because of the three important judgments - declared Right to Privacy a fundamental right, strikes down instant triple talaq and the conviction of 2002 rape accused Dera Sacha Sauda Chief Gurmeet Ram Rahim Singh for 20 years of imprisonment.
Three important decisions by Indian Judiciary
1) Triple Talaq
On 22nd August, 2017 Supreme Court held the Muslim practice unconstitutional and struck it down by 3:2 majority. The apex court called the practice a violation of Article of the Indian constitution which guarantees every citizen right to equality before the law. Triple Talaq is basically a verbal divorce that is practiced by Muslim community that gives them the power to instantly divorce their wives by saying ‘Talaq’ three times. This decision was praised by women across the country and termed it as ‘historic’ as the women in the Muslim community were the victims for the arbitrary divorce and seemed to be helpless.
2) Right to Privacy, a Fundamental Right
Right to Privacy a fundamental right, the decision was declared by a nine-judge constitution bench of Supreme Court on 24 August, 2017. The decision came after the Supreme Court overruled the M P Sharma and Kharak Singh cases, which had found the right to privacy was not protected by the Constitution. The court ruled that Right to Privacy is an ‘intrinsic part of Right to life and Personal Liberty under Article 21’ of the constitution. This decision by the Indian Judiciary proves that privacy is the most important thing and every individual has the Right to Privacy. It is referred as a landmark judgment by the Supreme Court as the right to privacy is a fundamental right and is an integral part of the right to life and liberty.
3) Ram Rahim Case
Dera Sacha Sauda Chief Gurmeet Ram Rahim Singh was sentenced for 20 years of rigorous imprisonment for raping two Sadhvis in Dera complex in Sirsa in 2002 by a special CBI court set up inside the Rohtak jail. Investigation will also be done to check the Dera’s financial affairs and other crimes which are associated with him. Though the justice was delayed for a very long time, however, this decision by the Indian Judiciary continues to receive applaud by the people across the country.
We hope that we get to see more such judgements by Indian Judiciary.
